1. Introduction

Welcome to Banana Prompts. These Terms of Service ("Terms") govern your access to and use of the Banana Prompts website, applications, APIs, and related services, including our prompt library, AI image generation features, credits, subscriptions, and account tools.

By accessing or using Banana Prompts, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. The Service

Banana Prompts provides tools and content related to AI creativity, which may include:

• Browsing and saving prompts
• Creating and managing user accounts
• Purchasing credits, subscriptions, or other paid plans
• Generating AI images from text prompts
• Uploading reference images for image generation
• Accessing generated images from your account history

We may update, improve, suspend, or discontinue parts of the service at any time.

3. Eligibility and Accounts

To use certain parts of the service, you may need an account.

• You must provide accurate and complete information when creating or maintaining an account.
• You are responsible for safeguarding your login credentials and for all activity under your account.
• You may not share your account in a way that circumvents plan limits, usage limits, or security controls.
• You must be at least 13 years old to use Banana Prompts.
• If you believe your account has been accessed without authorization, you must notify us promptly.

We may suspend or restrict accounts that appear to be fraudulent, abusive, compromised, or in violation of these Terms.

4. Plans, Credits, Billing, and Refunds

Banana Prompts may offer free features, one-time credit purchases, subscriptions, and promotional credits.

• Pricing, feature availability, credit allocations, and usage limits may change from time to time.
• Paid subscriptions may renew automatically unless you cancel before the next billing period.
• Credits may expire based on the plan, promotional terms, or billing period associated with those credits.
• Credits are non-transferable, non-refundable except where required by law or our posted refund policy, and have no cash value.
• Credits used for prompts, uploads, or generation requests involving prohibited content, including unlawful or sexually explicit/NSFW content, will not be refunded, even if the request is blocked, removed, moderated, or your account is suspended.
• Payment processing is handled by third-party payment providers. We do not store full payment card details on our own servers.
• You are responsible for all taxes, duties, and fees associated with your purchases unless stated otherwise.

Refund eligibility is governed by our separate Refund Policy.

5. Acceptable Use

You agree not to use Banana Prompts to:

• Violate any law, regulation, or third-party right
• Infringe intellectual property, privacy, publicity, contract, or other rights
• Generate, upload, request, or distribute unlawful, illegal, sexually explicit, NSFW, abusive, harassing, hateful, defamatory, fraudulent, or malicious content
• Create or facilitate spam, scams, malware, phishing, credential theft, or other harmful activity
• Attempt to reverse engineer, copy, scrape, resell, mirror, or exploit the service beyond permitted use
• Interfere with the operation, security, or reliability of the service
• Bypass rate limits, account limits, payment controls, or technical protections
• Use automated means to access the service in a way that imposes unreasonable load or violates our rules

We may investigate misuse and take action including content removal, credit adjustments, request blocking, account suspension, or termination.

6. Prompts, Uploads, and Generated Output

You are responsible for the prompts, reference images, and other content you submit to Banana Prompts ("Inputs"), as well as the images or other output generated from those Inputs ("Outputs").

• You represent that you have the necessary rights and permissions to submit your Inputs.
• You may not upload reference images or other content that you do not have the right to use.
• AI-generated results may be inaccurate, unexpected, incomplete, or similar to content generated for other users.
• You are responsible for reviewing Outputs before using, publishing, licensing, selling, or relying on them.

As between you and Banana Prompts, you retain whatever rights you may have in your Inputs and Outputs, subject to:

• the rights of third parties,
• the rights of model, hosting, payment, and infrastructure providers involved in delivering the service,
• applicable law, and
• any separate license, public-posting rule, or content notice that applies to content displayed publicly on Banana Prompts.

Our public prompt/archive content and other site materials may also be subject to separate notices, including our License page where applicable.

7. Our Rights to Operate the Service

You grant Banana Prompts a limited, non-exclusive, worldwide license to host, store, reproduce, transmit, modify, and process your Inputs and Outputs only as reasonably necessary to:

• operate and provide the service,
• complete generation requests,
• store generated images in your account when applicable,
• maintain security and prevent abuse,
• troubleshoot, support, and improve the service, and
• comply with legal obligations.

This license ends for deleted generated images once they are removed from our systems in the ordinary course of service operations, subject to backup, legal, fraud-prevention, and recordkeeping needs.

8. Content Availability and Deletion

• Generated images may be stored so you can view, download, and manage them from your account.
• If you delete a generated image from your account, we will remove the stored image file and related task records from our active systems.
• Temporary reference-image uploads may be stored for a limited period to support generation workflows.
• We do not guarantee indefinite retention of any content, account data, image history, credits, or features unless expressly stated.

You are responsible for keeping your own copies of content you want to retain.

9. Intellectual Property

Banana Prompts and its related branding, software, site design, original text, databases, interface elements, and service functionality are owned by us or our licensors and are protected by applicable intellectual property laws.

Except as expressly allowed by these Terms, you may not copy, distribute, modify, create derivative works from, publicly display, reverse engineer, or commercially exploit any part of Banana Prompts itself.

Third-party names, logos, models, product names, and trademarks mentioned on the service remain the property of their respective owners and do not imply endorsement unless expressly stated.

10. Service Availability and Changes

We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free availability.

• Features, models, image quality options, limits, and pricing may change over time.
• Processing speed and output quality may vary based on model behavior, system load, provider availability, moderation, and technical constraints.
• We may impose or change limits on storage, image generation, uploads, account usage, or API usage to protect the platform and other users.

11. Termination

We may suspend, limit, or terminate your access to Banana Prompts at any time if:

• you violate these Terms,
• you misuse the service,
• your payment is overdue or reversed,
• your activity creates legal, security, or operational risk, or
• we decide to discontinue the service or a portion of it.

You may stop using the service at any time. Termination does not relieve you of payment obligations already incurred and does not affect provisions that by their nature should survive termination.

12. Disclaimers

Banana Prompts is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law:

• we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and quiet enjoyment;
• we do not guarantee that the service will be secure, uninterrupted, error-free, or free of harmful components;
• we do not guarantee that prompts, outputs, or any generated content will be accurate, lawful, unique, merchantable, or fit for your intended use; and
• we do not guarantee that any content will remain available for any specific period.

13. Limitation of Liability

To the fullest extent permitted by law, Banana Prompts and its affiliates, licensors, service providers, and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or content arising out of or related to your use of the service.

If we are found liable for any claim arising out of or related to the service, our total liability will not exceed the greater of:

• the amount you paid to Banana Prompts for the service in the 12 months before the event giving rise to the claim, or
• USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Banana Prompts, its affiliates, licensors, service providers, and personnel from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• your Inputs or Outputs,
• your use of the service,
• your violation of these Terms, or
• your violation of any law or third-party right.

15. Privacy

Your use of Banana Prompts is also subject to our Privacy Policy, which explains how we collect, use, store, and protect information.

16. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we may provide notice by posting the updated Terms on this page, updating the effective date, or using other reasonable methods. Your continued use of Banana Prompts after the updated Terms become effective means you accept the revised Terms.

17. Governing Law

These Terms are governed by applicable law, without regard to conflict-of-law principles. If a court finds part of these Terms unenforceable, the remaining provisions will remain in effect.
